Alitan sa iyong employer sa Netherlands: mga hakbang na dapat gawin

Hindi pagkakaunawaan ng empleyado ng employer

In a conflict with your employer in the Netherlands, work in a fixed order: secure your position, record the facts, check your contract, the collective labour agreement (cao) and the law, and then raise the matter in writing. Do not resign or report sick because of the dispute: resigning normally costs you unemployment benefit, and a conflict alone is not illness.

Ano ang dapat mong gawin muna?

Separate three questions: is anything unsafe, is anything urgent, and what outcome do you actually want? The answers decide your next step.

If the conflict involves intimidation, discrimination or harassment, a different framework applies: under the Working Conditions Act (Arbowet) the employer must prevent and address psychosocial workload. Our page on panliligalig at paglabag sa batas sa trabaho nagpapaliwanag ng mga obligasyong iyon.

Some events start a deadline that cannot be restarted. Under Article 7:686a(4) of the Dutch Civil Code (BW) a request to the subdistrict court (kantonrechter) to challenge a dismissal or claim compensation must generally be filed within two months after the contract ends, and a claim for the transition payment (transitievergoeding) within three months. After that, the claim is lost.

Write down in one sentence what a good outcome looks like: clear expectations, a manageable workload, another manager, or a fair exit. Do not resign in anger: if you end the contract yourself, the UWV normally refuses unemployment benefit (WW).

How do you build a record?

Dutch employment disputes are decided on documents. Keep a short log of facts, not conclusions: date, time, who was present, what was said, through which channel, and the consequence.

Keep emails, chat messages, calendar entries, rosters and the relevant policy or cao clauses, and store them outside your employer’s systems. Your access to a company account can be closed the day the relationship breaks down.

Recording a conversation you take part in is not a criminal offence in the Netherlands and is in principle usable in civil proceedings, but it can damage trust if it comes to light. Do not copy customer data or company documents to a private account: that can be a breach of duty and a data breach under the GDPR. Keep only what concerns your own position.

What do your contract, the cao and the law say?

Four layers apply: your contract, the cao, company policy and the law. Check them all before any conversation.

Your contract sets role, place of work, hours, pay, notice and any non-compete or study-cost clause. A cao can apply because your employer falls within its scope, even if it is not a member of the employers’ association, for example after a declaration of general application. Company policy includes the staff handbook, complaints and whistleblowing procedures and sickness reporting rules.

Under Article 7:611 BW both parties must act as a good employer and a good employee. Under Article 7:660 BW you must follow instructions about the work, within the limits of the law and your contract. Under Article 7:613 BW the employer can only change terms unilaterally on the basis of a written amendment clause and with an interest so weighty that yours must give way. Without such a clause, the Supreme Court (Hoge Raad) expects you not to refuse a reasonable proposal prompted by changed circumstances (the Stoof/Mammoet standard).

How do you raise the issue?

Ask for a short private meeting and frame it neutrally. Bring three things: concrete observations, the effect on your work and a specific request.

A workable opening is: “In the last six weeks four projects were reassigned without discussion; I would like us to agree in writing on three priorities for this quarter.” A complaint about someone’s attitude gives the other side nothing to act on. If you feel unsafe, ask for a support person or go to the next management level.

Send a short, factual email the same day confirming what was discussed and agreed, who does what and by when. Write it as if a judge will read it. If a meeting is refused or postponed repeatedly, record that too: it is relevant to good employership under Article 7:611 BW. A confidential adviser (vertrouwenspersoon) or union representative can be a useful sounding board.

How do you escalate?

If the direct route fails, file a short written complaint with HR or a higher manager. State what happened, when, which rule it engages, the effect and what you ask for, and request a written outcome.

The works council (ondernemingsraad) has a right of consent on the complaints procedure under Article 27 of the Works Councils Act (WOR), but it does not decide individual disputes.

Mediation is voluntary, confidential and non-binding until an agreement is signed. It can aim to restore the relationship or to agree an exit without proceedings. Employers often pay for it, and refusing a reasonable mediation proposal can count against the refusing party later.

If the issue is a suspected wrongdoing affecting the public interest, such as fraud or a danger to public health, the Whistleblowers Protection Act (Wet bescherming klokkenluiders) applies. Employers with at least 50 employees must have an internal reporting procedure, and a reporter is protected against detrimental treatment. Use this route only for genuine public-interest reports. Our overview of Batas sa trabaho ng Dutch nagpapaliwanag kung paano magkakaugnay ang mga pamamaraang ito.

What if the conflict affects your health?

You may consult the company doctor (bedrijfsarts) preventively, before you are unfit for work and without your employer’s permission. The doctor can advise on adjustments or a short cooling-off period followed by mediation.

A conflict on its own is not illness. If you report sick because of a dispute and the company doctor finds no medical limitations, your employer may withhold salary. If either party disagrees with the company doctor’s advice, they can ask the UWV for an expert opinion (deskundigenoordeel).

During sickness you are entitled to at least 70% of your salary for up to 104 weeks (Article 7:629 BW). Under the Regulation on the first and second year of sickness, the company doctor makes a problem analysis and the employer draws up a plan of action with you within two weeks after it. Your diagnosis stays with the doctor; your employer only hears about limitations and possibilities. See our page on sick leave at reintegration.

How do you respond to a warning, improvement plan or suspension?

Each of these builds a file. Respond in writing, so that the file contains your side as well.

Babala Ask what exactly is alleged, on which rule it is based and how long it stays on file. Respond in writing with dates and evidence and ask for your response to be added to your personnel file. If asked to sign, sign “for receipt only”.

Improvement plan. Under Article 7:669(3)(d) BW dismissal for underperformance requires that the employer told you in good time and gave you enough opportunity to improve. Make sure the plan has measurable goals, support, realistic deadlines and reviews. If the goals are unachievable, say so in writing at the start.

Suspensyon Being placed on non-active duty does not end the contract or the salary. Ask in writing for the reason, the expected duration and confirmation that pay continues. If salary is not paid on time, you can claim it with a statutory increase of up to 50% (Article 7:625 BW) plus statutory interest. Wage claims become time-barred after five years (Article 3:308 BW).

What if it ends in dismissal or a settlement agreement?

Dutch dismissal law is closed. To end a permanent contract against your will, the employer needs permission from the UWV (for redundancy or long-term incapacity) or a dissolution by the subdistrict court on a statutory ground in Article 7:669(3) BW.

A disturbed working relationship is one of those grounds (Article 7:669(3)(g) BW), but only if continuing the contract cannot reasonably be required and redeployment is not possible. Under the cumulation ground (Article 7:669(3)(i) BW) the court can combine grounds and award up to half of the transition payment on top (Article 7:671b(8) BW). See our article on legal na paghawak ng pagpapaalis.

Most conflicts end in a kasunduan sa pag-areglo (vaststellingsovereenkomst). The transition payment is one third of a monthly salary per year of service, capped at €102,000 in 2026 or one annual salary if higher. If the employer acted seriously culpably, the court can add fair compensation (billijke vergoeding).

Check three points before signing. The agreement must protect your WW benefit: initiative with the employer, a neutral ground and the correct notice period. Under Article 7:670b BW you can dissolve the agreement in writing within 14 days without reasons, or three weeks if the agreement does not mention this right. And check the non-financial terms: reference, confidentiality, non-compete, holiday pay and bonus.

Mga madalas itanong

What is the first thing I should do in a conflict with my employer?

Pause and check safety, urgency and the outcome you want. Then record the facts, check your contract, the cao and company policies, and raise the issue in a focused conversation that you confirm in writing.

Can I report sick because of a conflict at work?

A conflict alone is not illness. If the company doctor finds no medical limitations, your employer may withhold salary. You can consult the company doctor preventively, and either party can ask the UWV for an expert opinion if they disagree with the advice.

Mawawala ba ang aking benepisyo sa kawalan ng trabaho kung pipirma ako ng kasunduan sa pag-aayos?

Not if the agreement is drafted correctly: the employer must have taken the initiative, the ground must be neutral and the notice period must be respected. Have the agreement reviewed before signing; under Article 7:670b BW you can still dissolve it within 14 days.

Kailan ako dapat magsama ng abogado?

At the latest when you are suspended, invited to a meeting about dismissal, offered a settlement agreement, when salary is withheld, or when the two-month deadline of Article 7:686a(4) BW approaches.
