Article 3(1) of the UN Convention on the Rights of the Child (UNCRC) requires that in all actions concerning children, their best interests are a primary consideration. In the Netherlands, courts and authorities must therefore establish what a decision means for the child and show in their reasons how that interest was weighed; it is not a trump card, so other weighty interests can still prevail.

The rule applies in batas ng pamilya, youth care, migration and ordinary civil cases such as eviction. In 2025 the Supreme Court (Hoge Raad) answered preliminary questions on the provision, which clarified what judges must do.

What does Article 3 UNCRC require?

Article 3(1) applies to courts, administrative authorities, legislative bodies and public or private social welfare institutions. The child’s interests must be a primary consideration: not the only one, but one that must be actively investigated and weighed.

The scope is broad. It covers decisions directly about a child, such as custody or a placement order, and decisions that affect a child indirectly, such as evicting a parent. Article 3(2) adds a broader duty for the State to ensure the protection and care the child needs, through legislation and administrative measures.

What must a Dutch judge do under Article 3?

The judge must find out, on its own initiative if necessary, whether a decision affects children and what serves their interests. The weighing must be visible in the reasons.

On 28 November 2025 the Supreme Court gave a preliminary ruling on evictions of families with children (ECLI:NL:HR:2025:1799), following the opinion of the Advocate General of 27 June 2025 (ECLI:NL:PHR:2025:728). It held that in an eviction case the judge must identify the children’s interests and give them high priority when assessing whether the tenant’s breach justifies termination of the lease.

Eviction is not automatically barred. The judge may not contact the municipality or care services outside the hearing, even with the parties’ consent, but can use procedural tools such as an expert report. A parent’s own culpable conduct does not reduce the weight of the children’s interests, and the judge can attach conditions to an eviction, such as a longer period to leave.

In practice this places responsibility on the parties and their lawyers. They must give the court concrete information about the children: their ages, schools, care needs and whether alternative housing is available.

How is the child’s interest filled in under Dutch law?

The concept is open and depends on the facts. Courts look at factors such as physical safety, emotional security, continuity of care and upbringing, and the child’s development.

Dutch law gives the standard concrete form in specific provisions. Article 1:377a of the Dutch Civil Code (BW) allows contact to be refused only on statutory grounds, including serious harm to the child; see our article on kapag maaaring limitahan ang mga kaayusan sa pakikipag-ugnayan. Sa isang utos ng pangangasiwa case, safety may dominate; in a relocation dispute, continuity of school and social environment may weigh more.

Under Article 1:250 BW, the court can appoint a special guardian (bijzondere curator) when the child’s interests conflict with those of the parents. The guardian represents only the child.

Paano naririnig ang bata?

Article 12 UNCRC gives the child the right to be heard. Under Article 809 of the Code of Civil Procedure (Rv), the court gives children aged 12 and over the opportunity to give their views in matters concerning them; younger children can be heard depending on their maturity.

The judge must ensure the child can speak freely, without pressure from either parent. If the judge does not follow the child’s wishes in order to protect the child, the decision must explain why. Read more in our article on ang mga kagustuhan ng bata sa mga kaayusan sa pakikipag-ugnayan.

When does the child’s interest prevail over other interests?

Not automatically. Article 3 must be weighed together with Article 8 of the European Convention on Human Rights (ECHR), the right to family life, which requires a fair balance between the individual and the community.

State intervention in a family must be necessary and proportionate, and a less intrusive measure comes first. On 11 February 2025 the District Court of Limburg terminated parental authority over a child who had lived outside the home since birth, after testing the measure against proportionality and subsidiarity under Article 8 ECHR and Article 1:266 BW (ECLI:NL:RBLIM:2025:1533).

Who is responsible, and who can be held liable?

The State is bound by the UNCRC, but in Dutch youth care the duty also reaches certified institutions (gecertificeerde instellingen) and care providers. Administrative decisions affecting children that do not show how their interests were weighed can be annulled for lack of reasons.

In migration cases, EU asylum law also treats the best interests of the child as a primary consideration. A guardian is liable to the child for damage caused by poor management, and a certified institution that falls short can be liable for a wrongful act (onrechtmatige daad) under Article 6:162 BW.

Safety weighs heavily in placement decisions. On 19 December 2025 the Supreme Court held that a missing or negative foster-care screening does not in itself bar a placement with a foster carer, but that safety concerns carry great weight: if the institution or the court finds the situation unsafe, the placement must be prevented or ended (ECLI:NL:HR:2025:1948).
